Summary	Expression of Interest for Development of eFTI Secondary Legislation Republic of Serbia The Government of Serbia has taken decisive steps to digitalise logistics and transport operations by aligning national practices with international standards and the European Union s regulatory framework A central instrument guiding this transformation is the EU Regulation 2020 1056 on Electronic Freight Transport Information eFTI Regulation which aims to streamline digital information exchanges across borders Effective implementation of the eFTI system requires extensive legal alignment technical assessments stakeholder engagement and system integration Under the first phase of the Serbia engagement 2025 2026 IFC provided comprehensive legal and advisory assistance to the Ministry of Construction Transport and Infrastructure hereinafter the Ministry to support the drafting of the legal framework to transpose the EU Regulation 2020 1056 into Serbian law That assignment resulted in a finalised draft Law on Electronic Freight Transport Information prepared in cooperation with GIZ regional Western Balkans eFTI project hereinafter the eFTI Law Additionally the team prepared the draft Law on Contracts in Road Cargo Transport which introduces the eFTI Regulation provisions into the road cargo transport and its Regulatory Impact Assessment In parallel multiple stakeholder consultations were held and the team has prepared an EU benchmarking study and organized a study visit to Italy Furthermore the Law on Ratification for e CMR Additional Protocol along with the accompanying legal explanation was drafted and adopted by the National Parliament in July 2026 enabling use of electronic CMR With the primary legislation now drafted the challenge shifts to the secondary legislative layer Article 17 of the eFTI Law establishes a mandatory 12 month deadline from entry into force for the adoption of all implementing by laws The following provisions of the Law contain explicit ministerial mandates to prescribe secondary legislation Article 5 the Minister in charge for transport shall prescribe the content and detailed rules for the exchange of regulatory information common procedures methods of submission storage and processing of data in freight transport access of competent authorities to eFTI platforms and communication between competent authorities and economic operators Article 6 the Minister in charge for transport shall prescribe national eFTI dataset subsets compatible with EU technical specifications within nine months of the adoption or amendment of those specifications by the European Commission Articles 10 the Minister in charge for accreditation shall prescribe the conditions for accreditation of conformity assessment bodies Articles 12 the Minister in charge for transport shall prescribe the functional requirements for eFTI platforms and eFTI service as well as the requirements for the certification of eFTI platforms and eFTI service providers Article 17 all implementing by laws shall be adopted within 12 months from the date of entry into force of the Law
